1. Agreement
These Terms of Use (the "Terms") form a binding agreement between you ("you," "your") and Verbadiem ("Verbadiem," "we," "us," "our") governing your access to and use of the Verbadiem website at verbadiem.com and any related products, services, content, and features (collectively, the "Service").
By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. About the Service
Verbadiem is a language-learning application that delivers one curated vocabulary word per day in your chosen language(s), along with native-quality audio, an example sentence, definition, etymology, and cultural context. A spaced-repetition review feature is available to paid subscribers.
3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
4. Account Registration
To use most features of the Service you must create an account by providing a valid email address. You are responsible for:
- maintaining the confidentiality of your account credentials;
- all activity that occurs under your account;
- providing accurate and current information; and
- notifying us promptly at support@verbadiem.com if you suspect any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or are inactive for extended periods.
5. Free and Paid Plans
The Service offers a Free plan and one or more Pro plans (collectively, "Subscriptions"). The current features of each plan, and the price of each Pro plan, are described at verbadiem.com/pricing. We may change plan features and pricing from time to time on notice to existing subscribers.
5.1 Billing
Paid Subscriptions are billed in advance on a monthly or annual cycle through our payment processor, Stripe. By starting a paid Subscription you authorize us (through Stripe) to charge your selected payment method on a recurring basis until you cancel.
5.2 Automatic renewal
Paid Subscriptions automatically renew at the end of each billing cycle at the then-current price for that plan. You may cancel auto-renewal at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing cycle; you retain access to Pro features until that date.
5.3 Refunds
We do not offer refunds for partial billing cycles or for unused portions of a Subscription. Where required by applicable law (for example, certain rights of withdrawal in the European Union), we will honor refund requests submitted within the statutory window.
5.4 Taxes
Where required, applicable sales tax, VAT, or other transactional taxes will be added at checkout and calculated automatically by Stripe.
5.5 Price changes
We may change Subscription pricing at any time. Price changes apply to your next billing cycle and will be communicated to you in advance by email.
6. Acceptable Use
You agree not to use the Service to:
- violate any applicable law, regulation, or third-party right;
- access the Service through automated means (bots, scrapers, headless browsers) other than well-behaved search-engine crawlers respecting our robots.txt;
- attempt to gain unauthorized access to any part of the Service, other accounts, or our infrastructure;
- interfere with, disrupt, or impose unreasonable load on the Service;
- redistribute, resell, or commercially exploit the Service or its content without our written permission;
- reverse-engineer, decompile, or attempt to derive the source code of any part of the Service (except where this restriction is prohibited by applicable law);
- use the Service to send spam, harassing communications, or content that is unlawful, defamatory, infringing, hateful, or harmful;
- impersonate another person or misrepresent your affiliation with any person or entity; or
- remove, obscure, or alter any copyright, trademark, or other proprietary notice in the Service.
We may suspend or terminate your account, with or without notice, for any violation of this section.
7. Intellectual Property
The Service, including its software, design, text, audio, images, vocabulary content, definitions, example sentences, cultural notes, etymology, and all other materials (collectively, the "Content"), is owned by Verbadiem or licensed to us, and is protected by copyright, trademark, and other intellectual-property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Content for your personal, non-commercial use, subject to these Terms.
Some Content is generated with the assistance of large language models (Anthropic Claude) and synthesized audio (ElevenLabs), curated by us before publication. Generated content does not constitute professional linguistic, translation, or educational advice.
You may not copy, modify, distribute, sell, sublicense, publicly perform, or create derivative works of the Content except as expressly permitted by these Terms or applicable law.
8. Feedback
If you send us feedback, suggestions, feature requests, bug reports, or other input about the Service (collectively, "Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that Feedback for any purpose, including improving the Service, without obligation to you.
9. Third-Party Services
The Service uses the following third-party services to operate. By using the Service you also agree to be bound by these providers' applicable terms:
- Stripe (payment processing) — stripe.com/legal

- Resend (transactional email) — resend.com/legal/terms-of-service
- ElevenLabs (text-to-speech audio) — elevenlabs.io/terms

Verbadiem is not responsible for the acts or omissions of these third parties.

The Service may contain links to third-party websites or resources. We are not responsible for the availability, accuracy, content, or practices of any third-party site, and inclusion of a link does not imply endorsement.
11. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, Verbadiem disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of content, uninterrupted availability, and freedom from errors or harmful components.
We do not warrant that:
- the Service will meet your specific learning goals or proficiency requirements;
- any vocabulary content, translation, definition, etymology, or audio pronunciation is free from error;
- the Service will be available without interruption, delay, or defect;
- defects in the Service will be corrected; or
- the Service is free of viruses or other harmful components.
You assume all responsibility for any decisions made or actions taken based on the Service or its Content.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event will Verbadiem, its founders, employees, agents, suppliers, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for all claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid to Verbadiem in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above apply only to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Verbadiem, its founders, employees, agents, suppliers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your access to or use of the Service;
- your violation of these Terms;
- your violation of any third-party right, including any intellectual-property or privacy right; or
- any content you submit to the Service.
14. Termination
We may suspend or terminate your account and access to the Service at any time, for any reason, with or without notice, including for violation of these Terms.
You may close your account at any time by contacting support@verbadiem.com or, where available, through your account settings. On termination, paid Subscriptions continue through the end of the then-current billing cycle and are not refunded, unless required by applicable law.
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution — will survive.
15. Modifications to the Service
We may modify, suspend, or discontinue any feature of the Service at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
16. Modifications to the Terms
We may update these Terms from time to time. Material changes will be communicated by email and/or by an in-app notice at least fourteen (14) days before they take effect, where practical. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
17. Governing Law

18. Dispute Resolution

The Service is operated from the United States. By using the Service from outside the US, you consent to the transfer of your information to the US and to its processing in accordance with our Privacy Policy.
If applicable law in your jurisdiction grants you stronger protections than these Terms or our Privacy Policy, those protections apply automatically.
21. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Verbadiem regarding the Service and supersede any prior agreements.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
